I hereby consent to be interviewed, recorded, photographed, videotaped or filmed by representatives of the FarMyth LLC, and Ryvid Inc. for purposes of publication, display or broadcast (print, web, digital display and all other forms of media).

I agree that such interviews, recordings, articles, quotes, photographs, films, audio or video and/or any reproductions of same in any form, are the property of FarMyth LLC, and I relinquish any present or future claim for reimbursement for said photographic or film reproduction of my likeness or for said testimonials by me.

I hereby release FarMyth LLC, its affiliates, employees, representatives and agents from any and all claims, demands, costs and liability that may arise from the use of these interviews, recordings, photographs, videotapes or films, and/or any reproductions of same in any form, as described above, arising out of being interviewed, recorded, photographed, videotaped or filmed.

I acknowledge that I have read this consent form in its entirety, or it has been read (or translated) to me, and I have had the opportunity to ask questions about it and understand it.

Trevor Agli has agreed to allow me, the undersigned, to engage in a free demonstration ride as an operator and/or a passenger of one or more Ryvid Anthem Electric Motorcycles. 

I fully understand and acknowledge that operating or riding on a motorcycle is an activity that has its own unique risks, and that serious injury or death could result from operating or riding on the motorcycle through no fault of my own, including from, but not limited to, equipment failure of the motorcycle, road conditions, vehicular traffic, and actions of other people. I am voluntarily participating in the demonstration ride(s) despite these inherent risks. I EXPRESSLY AGREE TO ASSUME THE ENTIRE RISK OF ANY ACCIDENT, PROPERTY DAMAGE, OR PERSONAL INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH, THAT I MIGHT SUFFER AS A RESULT OF MY OPERATING OR RIDING ON THE MOTORCYCLE AND PARTICIPATING IN THE DEMONSTRATION RIDE(s). 

By signing this Release, I, and on behalf of my heirs, successors, assigns, and personal representatives, hereby waive, release, absolve, and hold harmless, to the fullest extent permitted by the law, Trevor Agli, Ryvid Inc. and Ryvid Inc.’s affiliates, officers, directors, trustees, employees, agents and representatives, and their successors and assigns, collectively and individually (“Releasees”), from any and all liability, actions, causes of actions, debts, losses, judgments, damages, claims, or demands of any kind and nature whatsoever, including attorney’s fees and costs, that may arise out of or in connection with my participation in the demonstration ride, my use of the motorcycle, or any of the assumed risks as set forth above. 

I understand that this Release includes a release of all known and unknown claims. In giving the release herein which includes claims that may be unknown at present, I acknowledge that I have read and understand Section 1542 of the California Civil Code (and similar provisions of other jurisdictions), which Section reads as follows: 

“A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party” 

I expressly waive any and all rights and benefits conferred by the provisions of Section 1542. 

If I am the operator of the motorcycle, I represent that I possess the physical fitness, skill, knowledge, confidence, and experience on riding and operating motorcycles to operate the motorcycle in a safe manner. At minimum, I hold a current Ml or M2 license in the state in which I reside. I am not at this time under the influence of alcohol, drugs, or any other illegal substances, or any medications that may impair my judgment or my ability to operate or ride on the motorcycle. I am aware of the existing weather and road conditions. I am not aware of any physical, emotional, or other condition that would create a hazard to me or others as a result of my participation in the demonstration ride. 

I have examined the motorcycle, have been given a full review of all the motorcycle functions, and had an opportunity to ask questions regarding the operation of or riding on the motorcycle. I am satisfied that the motorcycle is in good operating condition and that I fully understand how to operate and ride on the motorcycle. 

I agree to operate or ride on the motorcycle safely, defensively, and within the limits of the law and my ability. I will only operate or ride on the motorcycle on designated demonstration routes, etc. determined by Trevor Agli..   

I understand and agree that if a legal claim or lawsuit is brought or sought against me as a result in any way of my participation in the demonstration ride or my use of the motorcycle, I will not be entitled to any defense or indemnification by Trevor Agli, Ryvid, Inc. or its affiliates, successors, and assigns in connection with that claim or suit. 

I also agree to at all times defend, indemnify, and hold harmless the Releasees from and against any and all claims, liabilities, damages, losses, and expenses (including, without limitation, reasonable attorneys’ fees) which may arise from my participation in the demonstration ride or my use of the motorcycle OR which may arise from any breach of any representation, warranty, or agreement I have made. 

I understand that this Release is binding on me and my successors, licensees, assigns, heirs, executors and administrators, and the rights granted to Releasees may be assigned or licensed in whole or in part to any person, firm or other entity.   

I understand that this Release does not create a joint venture, partnership, employment, agency, or similar relationship between Trevor Agli, Ryvid, Inc. and/or me. 

I understand that this Release is intended to be as broad and inclusive as permitted by law. If any provision or part of any provision of this Release is held invalid or legally unenforceable for any reason, the remainder of this Release will remain valid and fully enforceable. 

This Release will be governed by the laws of the State of California without regard to principles of conflict of laws. 

I understand and agree that this Release constitutes the full and complete Release between the parties and supersedes any prior written, oral, express, or implied agreements, understandings, communications, or statements. This Release cannot be modified except in writing signed by each party.   

I am over 18 years of age and have the right to make this Release.  I understand that I may have the Release reviewed by legal counsel before signing.  I have carefully and thoroughly read, understood, and approved this Release before executing it, and I agree to be bound by all its provisions.
